Top Trump adviser Stephen Miller blasted Democrats for prioritizing an alleged MS-13 gang member after the illegal immigrant was mistakenly deported despite having court-ordered protection. Miller questioned where the reprieve and due process were for American victims of horrific gang violence.

The firestorm centers on Kilmar Abrego Garcia, a 29-year-old Salvadoran man living in Maryland who is married to a U.S. citizen. Back in 2019, a court granted him protection from deportation because of gang threats back home. But last month, ICE shipped him back to El Salvador anyway, citing an outdated claim – which Garcia denies – of MS-13 affiliation.
Whoops! ICE later admitted the deportation was a bureaucratic blunder. Now Garcia is rotting in El Salvador’s infamous Terrorism Confinement Center, completely cut off from the outside world.
Despite the screw-up, the Trump administration is digging in its heels, refusing attempts to bring Garcia back. Their argument? He’s in El Salvador, so he’s out of U.S. jurisdiction. Tough luck.
That stance has drawn fire from judges, with U.S. District Judge Paula Xinis and an appeals panel slamming the administration’s inaction as a “shocking disregard for the rule of law.”
But Miller echoed the sentiments of many Americans asking why alleged foreign gang members seem to get more attention and legal wrangling than the citizens they terrorize. The battle over Garcia’s fate rages on, highlighting the clash between immigration enforcement and judicial oversight.
