Riley Gaines Act prohibits trans males from women’s spaces

West Virginia has recently made headlines after enacting the Riley Gaines Act, a law that prohibits trans-identified males from accessing women’s designated spaces.

The Riley Gaines Act was backed by a significant majority in both the West Virginia Senate and House, showcasing strong Republican support and limited dissent from across the aisle.

The legislation provides a concrete definition of what constitutes a male and female based on biological attributes, asserting that “there are only two sexes.”

This act specifies that schools, shelters, and prisons must designate restrooms and changing facilities according to sex as defined by this law.

Legal representatives from the Alliance Defending Freedom have praised the law, arguing it is essential to protect the privacy and dignity of women and girls.

However, the American Civil Liberties Union of West Virginia has criticized the legislation as regressive, claiming it stigmatizes trans individuals.

The ACLU emphasizes that such measures could foster environments ripe for harassment, warning against the implications of the law.

This move makes West Virginia the 17th state to enforce similar laws requiring individuals to use restrooms and other sex-segregated spaces that correspond to their biological sex.

Other states, like Florida and Alabama, have enacted comparable laws, with varied scopes affecting government and school facilities.
